Waiver Release of Liability for Kid Car Parties

I, ____________________________, hereby acknowledge and agree to the terms and conditions set forth in this Waiver Release of Liability ("Agreement") in consideration for participating in activities provided by Kid Car Parties, a rental company offering Kids Ride-On vehicles with speeds ranging from 2.5 to 5 mph.

Assumption of Risk: I understand and acknowledge that participating in activities involving the use of ride-on vehicles provided by Kid Car Parties carries inherent risks, including but not limited to the risk of injury due to falls, collisions, or malfunction of equipment. I voluntarily assume all such risks and agree that Kid Car Parties shall not be held liable for any injuries, damages, or losses sustained as a result of my participation, except where such injuries, damages, or losses are caused by the gross negligence or willful misconduct of Kid Car Parties.

Release and Waiver of Liability: In consideration for being permitted to participate in activities provided by Kid Car Parties, I, on behalf of myself, my heirs, successors, assigns, and legal representatives, hereby release, waive, discharge, and covenant not to sue Kid Car Parties, its officers, directors, employees, agents, and representatives from any and all claims, demands, actions, causes of action, suits, damages, losses, liabilities, and expenses (including attorney fees) that I may have now or in the future, whether known or unknown, arising out of or in any way related to my participation in activities provided by Kid Car Parties, including but not limited to any claims for personal injury, property damage, or wrongful death.

Indemnification: I agree to indemnify, defend, and hold harmless Kid Car Parties, its officers, directors, employees, agents, and representatives from and against any and all claims, demands, actions, causes of action, suits, damages, losses, liabilities, and expenses (including attorney fees) arising out of or in any way related to my participation in activities provided by Kid Car Parties, including but not limited to any claims brought by third parties arising out of my conduct or actions.
Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby.

Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of State of California. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of State of California.

I HAVE READ AND UNDERSTAND THIS WAIVER RELEASE OF LIABILITY AGREEMENT AND VOLUNTARILY AGREE TO ITS TERMS AND CONDITIONS.
